OpenAI's ChatGPT faces data protection breach allegations in Europe

In a move with implications across the Eurozone The Italian Data Protection Authority (DPA), Garante per la protezione dei dati personali, has issued a notice to OpenAI, the company behind the AI platform ChatGPT, for alleged breaches of data protection law.

Around thew world regulators are moving with uncommon swiftness to tackle AI. The US FTC is investigating a deal between OpenAI and Anthropic (and their giant industry backers), while the EU has an ongoing investigation into Microsoft's investments into OpenAI.

The Italian move follows a temporary processing ban imposed on OpenAI by the Garante on 30 March of the previous year. The Italian DPA concluded that the evidence pointed to breaches of the provisions contained in the EU General Data Protection Regulation (GDPR). OpenAI now has 30 days to submit counterclaims concerning the alleged breaches. The Italian Garante will consider the work in progress within the ad-hoc task force set up by the European Data Protection Framework (EDPB) in its final determination on the case.
